These Terms of Service govern your access to and use of Ride Hermes, a service operated by Burs Labs, LLC. By creating an account, accessing the service, or using any Ride Hermes feature, you agree to these terms.
You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account. You may not use Ride Hermes if your access has been suspended or terminated.
Ride Hermes may allow you to upload profile details, rides, trails, comments, messages, images, and other content. You retain your rights in content you submit, but you grant Burs Labs, LLC a non-exclusive license to host, use, display, reproduce, and distribute that content as needed to operate, improve, and support the service.
You are responsible for the content you submit and for ensuring you have the rights needed to share it.
Ride Hermes offers paid features, including recurring memberships and digital credit purchases. Additional terms apply to subscriptions, credits, refunds, and billing support. Those terms are part of your overall agreement with Ride Hermes.
Some purchases are processed by third parties, including Stripe for web checkout and Apple, Google, and RevenueCat for mobile purchase flows. Your use of those processors and stores may also be subject to their terms, billing rules, and policies.
Ride Hermes may display trail, route, leaderboard, mapping, location, and user-generated information related to outdoor activities. Outdoor recreation and trail riding involve inherent and significant risk, including the risk of serious injury, death, property damage, getting lost, changing weather, trail hazards, vehicle failure, collisions, trespass, citations, and emergency response delays.
You are solely responsible for deciding whether to travel to, access, ride, or use any trail, route, or outdoor location referenced through Ride Hermes. You must follow all local laws, land-use rules, closures, permit requirements, posted signs, and property restrictions. You must check that a trail is open, lawful, and appropriate for your activity, vehicle, skill level, equipment, and current conditions.
You are also responsible for riding responsibly, respecting land managers, private property, wildlife, and other trail users, and using appropriate judgment before relying on any user-submitted or service-provided information.
Ride Hermes does not guarantee that any trail, route, condition, location, legality, access status, description, difficulty rating, or safety information is accurate, complete, current, lawful, or suitable for your intended use.
You assume the risks of using Ride Hermes in connection with outdoor activity and trail riding. To the fullest extent permitted by law, Burs Labs, LLC will not be liable for injuries, deaths, property damage, fines, citations, trespass claims, towing, rescue costs, or other losses arising out of or related to trail access, trail conditions, riding activity, reliance on service content, or your use of Ride Hermes in connection with outdoor recreation.
Burs Labs, LLC may suspend, limit, or terminate access to Ride Hermes if we believe you violated these terms, created risk for the service or other users, engaged in fraud or abuse, or if continued service is no longer commercially or operationally practical.
Suspension or termination may affect access to paid or earned features where allowed by law and consistent with the applicable subscription, credits, and refund terms.
Ride Hermes may change over time. We may update, improve, limit, or discontinue features, products, or parts of the service. We do not guarantee that any feature will remain available indefinitely.
Ride Hermes is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Burs Labs, LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the fullest extent permitted by law, Burs Labs, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising out of or related to Ride Hermes.
To the fullest extent permitted by law, our total liability for claims arising out of or related to Ride Hermes will not exceed the amount you paid to Burs Labs, LLC for the specific paid feature giving rise to the claim during the twelve months before the event giving rise to the claim, or one hundred U.S. dollars if you did not make a relevant payment.
We may update these terms from time to time. When we do, we will update the "Last updated" date on this page. Continued use of Ride Hermes after updated terms take effect means you accept the updated terms.
